Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and services provided by Arkle1 ("Arkle1," "we," "us," or "our"). By using our website or services, you agree to these Terms.

Acceptance of terms

By using our website, taking the assessment, contacting us, or engaging any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

Description of services

Arkle1 provides business operations consulting for owner-run small businesses. Our services include a free online assessment and report, the Operations Blueprint, the Build, the Implementation, and an ongoing retainer. The work is advisory and hands-on: we assess how your business runs, write a plan, and where engaged to do so, set up and roll out the systems and workflow the plan calls for.

Arkle1 does not engage in affiliate marketing or the buying or selling of leads. We do not sell your information.

The assessment and your report

The assessment is free and automated. It scores the answers you give and returns a report with a stage, a bottleneck, and estimated ranges. Those ranges are estimates based on your answers and general benchmarks. They are not an audit, not a valuation, and not a promise of any result. You are responsible for the accuracy of the answers you provide, and the report is only as good as they are.

Text messaging

Arkle1 sends text messages about assessment results, booking links, appointment confirmations and reminders, and, if you opt in separately, marketing messages. Message frequency varies. Msg & data rates may apply. Text STOP to cancel at any time and HELP for help, or contact [email protected]. Carriers are not liable for delayed or undelivered messages. You must be 18 or older to sign up. See our Privacy Policy at https://arkle1.com/privacy.html.

A phone number is optional everywhere we ask for one, and both consent boxes start unchecked. Neither is a condition of purchase. The SMS consent page carries the opt-in form and the exact wording of both boxes.

Fees, billing, and cancellation

  • The assessment and the report are free. No payment details are collected.
  • The Operations Blueprint is a fixed fee, quoted and agreed before we start, and payable upfront. If you engage us for the Build within 60 days of delivery, that fee is credited against it.
  • The Build and the Implementation are quoted per roadmap item before work begins. Each item is invoiced when its build lands.
  • The retainer is billed monthly. There are no long-term contracts. Either side may cancel with 30 days notice.
  • Invoices are due on the terms stated on them. Work may be paused on overdue accounts. Fees already earned are non-refundable.

What we need from you

Our work depends on access and participation. You agree to give us accurate information about how your business runs, reasonable access to the people and tools involved, and timely decisions and approvals. Timelines we quote assume that access. If it does not arrive, timelines move.

Acceptable use

You agree not to use our website or services to:

  • Violate any applicable law, regulation, or carrier or messaging policy.
  • Send unlawful, harassing, deceptive, or unsolicited messages.
  • Infringe the rights of others or misuse another party's information.
  • Submit information that is false or that belongs to someone else without their permission.
  • Interfere with, disrupt, or attempt to gain unauthorized access to our systems.

Intellectual property

All content, branding, software, methods, templates, and materials made available through our website and services are owned by Arkle1 or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

Once paid for in full, the written deliverables we prepare for your business, including your Operations Blueprint, are yours to use inside your business. The underlying methods, frameworks, and templates we used to produce them remain ours, and we may reuse them with other clients.

Confidentiality

What you tell us about your business stays between us. We use it to do the work and for nothing else, and we do not share it with anyone outside Arkle1 except where you ask us to or the law requires it. The same obligation runs the other way for anything we share with you that is marked or clearly confidential.

Third-party tools

Some of our work involves configuring or connecting software you license from other companies. Those tools are governed by their own terms and pricing, which you accept directly with them and pay for separately. We are not responsible for their availability, their changes, or their failures.

Disclaimers and limitation of liability

Our website, the assessment, and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee any particular business, financial, or operational result. You remain responsible for how you run your business and for the decisions you make.

To the maximum extent permitted by law, Arkle1 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of our website or services. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us for the engagement giving rise to it in the twelve months before the claim.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Florida, where Arkle1 operates, without regard to its conflict of laws principles.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of our website or services after any change indicates your acceptance of the updated Terms.
